Before You Request a Payment from an Estate
When someone dies owing money, creditors may be able to request payment from the person's estate by filing a Creditor's Claim with the probate court.
The court appoints a personal representative to manage the estate. The personal representative must notify creditors, usually through a newspaper notice and by mailing notices to known creditors.
Important: There are strict deadlines for filing creditor claims.
- Generally, 90 days for general probate administration.
- Generally, 60 days for summary administration.
- Special deadlines may apply to creditors who receive notice by mail.
Important: Missing the deadline may prevent you from collecting the money owed.
